Terms & Conditions of Use

These Terms and Conditions govern your use of UpcShovDown.com. By opening an account or placing a wager, you agree to these terms. Please read them carefully and keep a copy for your records.

1. Who operates UpcShovDown.com

UpcShovDown.com is owned and operated by UPCOZ Pty Ltd ABN 93 621 899 634 (referred to as "UpcShovDown", "we", "us" or "our"). Our registered office is located at 101 Sheridan Street, Cairns QLD 4870, Australia. We are licensed by Liquor & Gaming NSW to provide sports and racing wagering services under the Betting and Racing Act 1998 (NSW), Sports Betting Licence No. 4597/2024/WB.

2. Service offered

UpcShovDown.com offers fixed-odds wagering on Australian and selected international sports and racing markets. The service is provided online to verified account holders. UpcShovDown.com is not an online casino. We do not offer casino games, poker, slots, lotteries, cryptocurrency wagering, derivative products, contracts for difference or any other financial or investment product. Online in-play wagering on sports is prohibited under the Interactive Gambling Act 2001 (Cth) and we do not accept in-play bets through our website or app.

3. Account eligibility

To open and hold an UpcShovDown account, you must:

• Be at least 18 years of age;
• Be ordinarily resident in Australia;
• Provide truthful, accurate and complete information at registration and keep that information current;
• Open the account in your own name and for your own use only — accounts opened on behalf of any other person are not permitted;
• Not be currently registered on the National Self-Exclusion Register (BetStop) or self-excluded with UpcShovDown or, to the best of your knowledge, with any other Australian wagering provider;
• Not be an employee, contractor or close family member of an UpcShovDown employee or contractor, where prohibited by our internal policies.

4. One account per person

You may hold one (1) UpcShovDown account only. Where we identify duplicate accounts held by the same individual, we may suspend, merge or close the additional accounts and void any bets placed in breach of this rule. Repeated duplicate accounts may result in permanent account closure.

5. Identity verification (KYC)

UpcShovDown is required under the Betting and Racing Act 1998 (NSW), the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) and the National Consumer Protection Framework for Online Wagering to verify the identity of every account holder. You may be asked to provide an Australian driver licence, Medicare card, current Australian passport or other accepted identity information. Verification is usually completed promptly. Withdrawals cannot be released until identity verification is complete.

6. AML/CTF and source-of-funds checks

UpcShovDown is a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). We are required to monitor activity, report certain transactions to AUSTRAC and, in some cases, request additional information from you about the source of your funds or source of wealth. We may suspend deposits, withdrawals or wagering on your account until these checks are completed. Failure to provide reasonably requested information may result in account closure.

7. BetStop and self-exclusion

If you are registered on the National Self-Exclusion Register (BetStop) or hold an active self-exclusion with UpcShovDown, you must not attempt to open or use an UpcShovDown account. Any bets placed in breach of an active self-exclusion may be voided and stakes returned to a verified bank account in your name. Self-exclusion through BetStop applies across every licensed Australian wagering provider for the period you choose (minimum three months, maximum lifetime).

8. Deposits

UpcShovDown accepts deposits in Australian dollars from approved payment methods only. We accept Visa Debit, Mastercard Debit, PayID, BPAY, Apple Pay and Google Pay. Credit cards are not accepted for any deposit, in line with the prohibition under Australian law. Minimum deposit is $10. We do not accept deposits in cryptocurrency, foreign currency, cash or anonymous payment instruments. Your bank or wallet provider may charge fees, which are not controlled by UpcShovDown.

9. Withdrawals and payment ownership

Withdrawals are returned to a verified Australian bank account held in the name of the account holder. Withdrawals to third-party accounts, joint accounts not held by the customer, prepaid cards, or accounts outside Australia are not accepted. Minimum withdrawal is $20. Withdrawals are processed during business hours and most land the same business day in your nominated bank account. We may delay a withdrawal where additional identity, AML/CTF or source-of-funds checks are required.

10. Bet acceptance and settlement

A bet is only accepted once it has been confirmed by our system and a bet receipt has been issued. Bets are settled based on the official result of the relevant market. Where an official result is unavailable, we may settle on the basis of widely reported or governing-body results, acting reasonably and in good faith. Settlement times depend on the sport and the governing body. We may withhold settlement where a market is being investigated for integrity reasons.

11. Incorrect prices, obvious errors and void bets

UpcShovDown may void any bet that is placed at an obviously incorrect price, accepted in error, placed on a market that should have been suspended, or placed after a material event has occurred. Bets submitted while a market is suspended may be rejected or voided. Where a bet is voided, the stake is returned to your account.

12. Voids, dead heats and rule four

If an event does not start on the scheduled day or is abandoned without an official result, all match-result bets are void and stakes are returned. Dead heat rules apply to win, place, top scorer and similar markets. Deductions may apply to racing markets when a runner is scratched, in accordance with the applicable racing rules and market terms.

13. Maximum payout

The maximum aggregate payout per customer per ticket across all UpcShovDown sports and racing markets is $500,000. Where individual markets, leagues or events have lower maximum payouts, the lower limit applies.

14. Responsible gambling tools

You can set deposit limits, loss limits and session limits at any time from your account settings. Lower limits apply immediately. Increases to any limit take 7 days to come into effect, in line with the National Consumer Protection Framework. 15. Promotions and offers

UpcShovDown does not advertise sign-up, deposit or referral inducements. Where a wagering product or offer is made available to eligible verified account holders, it will be governed by its own specific terms published on UpcShovDown.com. Eligibility may depend on identity verification, residency, account standing, prior responsible gambling settings and other reasonable conditions.

16. Account security

You are responsible for keeping your login details, password and any device used to access your UpcShovDown account secure. You must not share your account credentials with any other person. We may apply additional security measures, including multi-factor authentication, where we consider it necessary. Tell us immediately if you suspect your account has been accessed without your authorisation.

17. Prohibited conduct

You must not:

• Open or operate an account on behalf of any other person or under a false identity;
• Use any automated system, bot or script to interact with UpcShovDown.com;
• Attempt to manipulate markets, collude with other customers, or breach the integrity rules of any sport or racing body;
• Use UpcShovDown for any unlawful purpose, including money laundering or financing of terrorism;
• Use UpcShovDown while located outside Australia, where doing so is prohibited by the laws of your location.

18. Account suspension and closure

UpcShovDown may suspend or close your account at any time, including where you breach these terms, where required for identity, AML/CTF, integrity or responsible gambling reasons, or where required by law or by our licence conditions. You may close your account at any time by contacting support@upcshovdown.com. Withdrawable balances will be paid to a verified Australian bank account in your name, subject to any outstanding checks.

19. Inactive accounts

Accounts with no betting activity for 12 months are placed on inactive status. We will email you a notice 30 days before any maintenance fee or transfer to unclaimed money is applied, in line with applicable state and Commonwealth legislation.

20. Complaints and dispute handling

If you have a complaint, please contact us first by emailing support@upcshovdown.com. We will acknowledge your complaint and aim to provide a substantive response within a reasonable period. If a dispute is not resolved through our internal process, you may escalate it to:

• Liquor & Gaming NSW — for matters relating to our wagering licence and conduct;
• NSW Office of Responsible Gambling — for responsible gambling concerns;
• NSW Fair Trading (13 32 20) — for general consumer disputes.

21. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Cookies and similar technologies are described in our Cookie Policy.

22. Changes to these terms

UpcShovDown may change these Terms and Conditions at any time. Changes take effect when published on UpcShovDown.com. Material changes will also be notified to you by email at the address registered to your account. Your continued use of the service after a change has been published constitutes acceptance of the updated terms.

23. Governing law

These Terms and Conditions are governed by the laws of New South Wales and the Commonwealth of Australia. You and UpcShovDown submit to the non-exclusive jurisdiction of the courts of New South Wales for any matter arising out of or in connection with these terms.
